Agreement and eligibility

These Terms govern Apex Artist at apexartist.space. Apex Artist is the name under which the studio is operated. Account features require explicit acceptance of the current Terms after sign-in. Google authentication alone does not record agreement. Public browsing does not require an account.

You must have legal capacity and any permission required by applicable law and the selected provider. If acting for an organization, you confirm authority to bind it. Do not use the service where prohibited. The Privacy Policy separately explains data handling; accepting these Terms is not consent to optional marketing.

Early access and account security

Apex Artist is an early-access AI creative studio. Features, models, settings and limits may change; some are previews or invitation-only. A preview does not submit a live generation. We do not promise uninterrupted availability, a particular model or a particular creative result.

Use accurate account information, protect your credentials and report suspected unauthorized access to support. You are responsible for activity you authorize. Do not impersonate others, sell or share access to bypass restrictions, or access another account's private records.

Your inputs, rights and permissions

You retain rights you already hold in your prompts and files. You represent that you have the rights, licenses and permissions needed to submit and process them, including copyright, privacy, publicity, likeness and voice permissions. Do not submit stolen, confidential or personal information without authorization. Permission to depict a person must cover your intended use, including commercial use where applicable.

You grant Apex Artist and the providers involved in your request non-exclusive permission to temporarily host, transmit, reproduce and process inputs as needed to deliver requested features, check safety and resolve service issues. This does not transfer input ownership or give Apex Artist an unrestricted right to sell your inputs. Provider retention and handling are described in the Privacy Policy and applicable provider terms.

Prohibited use

Do not use the service for unlawful activity, child sexual exploitation, non-consensual intimate content, fraud, deceptive impersonation, threats, targeted harassment, infringement or privacy violations. Follow provider safety rules, including restrictions on faces and voices of minors. Do not present fabricated media as authentic evidence or use it to mislead people about someone's identity or conduct.

Do not bypass moderation, authentication, Credits accounting or upload limits; introduce malicious code; scrape private data; probe accounts without authorization; or disrupt the service. Do not use multiple accounts or automation to evade allowances. We may reject inputs or outputs and investigate suspected abuse.

AI outputs and commercial use

Outputs can be inaccurate, unexpected, non-exclusive or similar to existing works. We do not guarantee originality, copyright protection, factual accuracy, fitness for a purpose or clearance for commercial use. Apex Artist does not claim ownership of rights you may acquire in outputs; those rights depend on applicable law, source material and provider terms. Review outputs and obtain needed permissions before publishing or commercial use.

Outputs are not professional medical, legal, financial or other advice. You are responsible for how you use and share them, including legally required synthetic-media disclosures. Do not rely on generations for safety-critical decisions.

Download completed media to keep your own copy. Provider links and reference handles can expire. The studio is not permanent media storage; an expired link does not establish deletion from provider systems.

Credits and generation outcomes

Credits are account-specific usage units, not money, deposits or transferable currency. Review the current estimate before clicking Generate. Cost depends on model, settings and references. Live generation requires eligible access, sufficient Credits and current Terms acceptance.

Credits are reserved when a live request is accepted. Confirmed failed, safety-rejected or canceled requests return reserved Credits. An uncertain submission retains its reservation while the provider outcome is reviewed. Do not repeat an uncertain request. Paid submissions are not automatically retried. Contact support for investigation.

An unwanted completed result, playback problem or expired link does not automatically return Credits. We investigate service errors based on confirmed outcomes. Mandatory legal remedies remain available.

Checkout, paid subscriptions and Credit purchases are not active; Plans are a preview. Future paid offerings must disclose prices, billing, cancellation and refund conditions before purchase. These Terms do not authorize undisclosed charges.

Third parties, changes and restrictions

Authentication and generation depend on third-party services. Follow applicable provider usage rules. Provider outages, moderation and changed capabilities can affect availability. Provider terms do not expand Apex Artist's rights in your content beyond what we disclose.

We may restrict or suspend access where reasonably necessary to address abuse, security risks, violations, legal requirements or provider restrictions. Where practicable, we will explain the restriction and offer review through support. Emergencies or legal restrictions may require action without notice. Suspension does not erase unresolved accounting or generation records.

We may change or discontinue features without imposing undisclosed charges or removing mandatory rights. Contact support about unresolved requests when closing an account.

Warranty disclaimer and liability limits

To the extent permitted by law, the service and outputs are provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee the service is uninterrupted, secure or error-free, or that outputs meet your expectations.

To the extent permitted by law, Apex Artist and its operator are not liable for indirect, incidental, special or consequential losses, including lost profits, opportunities or data. Total liability arising from the service is limited to the greater of US$100 (or its local equivalent) and the amount you paid Apex Artist for the service during the twelve months before the event giving rise to the claim.

These exclusions and limits do not apply where prohibited by law. They do not remove mandatory consumer rights or liability that cannot legally be limited, such as fraud or deliberate misconduct. Where an exclusion cannot apply, liability is limited only as the law permits.

Third-party claims and copyright reports

To the extent permitted by law, you are responsible for reasonable losses and costs arising from third-party claims caused by unlawful inputs, infringement of others' rights or your material breach of these Terms. This does not cover claims caused by Apex Artist's own wrongful conduct. We will give reasonable notice, allow you to respond and will not settle a claim imposing obligations on you without your consent. Mandatory consumer protections take precedence.

Send copyright, privacy, safety and legal reports to support@apexartist.space. Identify affected content, the rights or issue involved, supporting information and contact details. Copyright reports should confirm you are the rightsholder or authorized representative and that the report is accurate. We may request more information and restrict disputed content or access during review. Do not submit knowingly false reports.

Acceptance records, updates and closure

We record your account ID, accepted Terms version and document fingerprint, server acceptance time, acceptance method and Privacy Policy version acknowledged. One record is kept per accepted version. Material changes require a new explicit acceptance; prior records are not rewritten. Updated Terms do not retroactively change already completed activity.

You may stop using the service and request closure or deletion through support. Retention and deletion follow the Privacy Policy. Provisions that logically need to survive closure, including unresolved accounting, content responsibilities and lawful liability limits, continue to apply.

These Terms govern the service alongside conditions clearly presented before a feature or purchase is used. If a provision is unenforceable, remaining provisions continue to apply. Delay in enforcement does not waive a provision. Mandatory rights remain unaffected. Nothing prevents claims or remedies in a court or authority available under applicable law.
